Company inks deal with Ace
HOLLY HILL -- Getting a new product into the distribution system for Ace Hardware stores is a dream for any product developer and manufacturer.
But the dream's come true for Holly Hill-based BGA Industries.
The company recently signed a deal to supply 20-pound bags of Yard Gard, an armadillo deterrent pellet, to four Ace warehouses, which supply the hardware-store chain's locations in 16 states throughout the Southeast U.S. from Virginia to Texas and Kansas.
It's quite a change from two-years ago when BGA made deliveries from the back of a Ford Excursion to just a few area Ace stores.
"This is something we've been trying for quite some time," BGA President Mel Mathisen said. "Getting into the warehouses is a blessing, and it means stores can order it automatically from the warehouses. It's more convenient for them and can help spread the product faster."
The deal has allowed BGA to expand by moving into a larger space at 460 LPGA Blvd. The company, which employed two people up until recently, has hired a half-dozen production workers and could soon add more if sales of its Yard Gard product pick up significantly, as expected.
BGA targeted Ace's distribution network, Mathisen said, because its stores are independently owned and is easier to get to carry new products than the big national home improvement store chains such as Lowe's and The Home Depot.
However, because Ace Hardware stores are independently owned, its individual franchise owners are not required to carry Yard Gard, said Kate Kirkpatrick, an Ace Hardware spokeswoman.
"It's been in the warehouses just three weeks," Kirkpatrick said. "We do have regional buyers who send out quarterly newsletters to store owners that list new products. This takes some time. It's a process, but I'm sure it's exciting for a small company to have this opportunity."
It's a golden opportunity for BGA Industries that was created four years ago as a way for Mathisen to balance out the volatile ups and downs experienced by his other company, Daytona Glass.
That company manufacturers industrial blown glass for semiconductor and fiber-optics industries at a Jimmy Ann Drive plant in Daytona Beach and at a site in Eustis.
"We hire and train people and then have to let them go. They end up going somewhere else and we have to start the process over again. It's a nuisance," Mathisen said. "We had as many as 25 employees and have been down to two some times.

How Can I Correct the Inventors Listed on - Patents101
Listing the correct inventors on your patent application is important. Having an incorrect listing can result in invalidity or unenforceability of your patent, loss of ownership rights, and other serious issues. Determining the correct inventorship for a patent application is a legal matter that should be determined by your patent attorney.
Two types of errors can be made with regard to inventorship, misjoinder and nonjoinder. Misjoinder is where a person listed as an inventor is not actually an inventor. Nonjoinder is where an actual inventor is not listed as an inventor. If there is no intent to deceive on the part of the person improperly listed or not listed, these errors can be corrected either while the patent application is still pending or after issuance of the patent. However, correction should be made as soon as possible.
If the list of inventors is erroneous due to an attempt at deception by the improperly named or unnamed inventors, the application’s inventorship cannot be corrected. In some circumstances, the inventorship of an issued patent can be corrected in spite of a deceptive intent, although the patent may be unenforcable (that will be addressed in a future post).
The procedure for correcting a provisional patent application is explained below. The procedure for nonprovisional applications differs, and will be explored in a future post.
